1. Terms and Definitions

1.1. Seller – Individual Entrepreneur (Sole Proprietor)

1.2. Buyer – any legally capable individual who receives information from the Seller, places an order, and purchases products on the website www.lumouss.com for personal use not related to business activity.

1.3. Product – facial skincare cosmetics and related products presented in the online store.

1.4. Online Store – the Seller's website located at www.lumouss.com, intended for the remote sale of products.

2. General Provisions

2.1. This document is an official public offer from the Seller to enter into a purchase and sale agreement with any Buyer under the terms set out in this offer.

2.2. The agreement is considered concluded from the moment of acceptance – when the Buyer clicks the "Place Order" button on the order confirmation page.

2.3. All terms of the agreement are the same for all Buyers in accordance with Article 633 of the Civil Code of Ukraine.

2.4. The Seller reserves the right to amend the terms of the offer without prior notice. Changes take effect from the moment they are published on the website.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer ownership of the Product to the Buyer, and the Buyer undertakes to pay for and accept the Product under the terms of this offer.

4. Placing an Order

4.1. The order is placed by the Buyer independently through the online store's website.

4.2. After placing an order, the Buyer receives a confirmation to the specified email address.

4.3. By placing an order, the Buyer consents to the processing of personal data in accordance with the Law of Ukraine "On Personal Data Protection."

4.4. The Seller has the right to cancel an order at the confirmation stage.

4.5. The Buyer is responsible for the accuracy of the information provided. In case of data errors, the Seller is not liable for the inability or delay in fulfilling the order.

5. Price and Delivery of Products

5.1. Prices on the website are listed in hryvnias and are valid at the time of order placement.

5.2. Delivery is carried out by delivery services in accordance with their rates.

5.3. Payment is made using the methods available on the website.

5.4. Ownership of the Product transfers to the Buyer from the moment of actual transfer of the Product to the Buyer or the carrier (depending on delivery terms).

5.5. For international delivery, customs duties and taxes of the recipient's country are paid by the Buyer independently.

6. Rights and Obligations of the Parties

6.1. The Seller undertakes to:

- transfer the Product in accordance with the terms of the agreement;

- not disclose the Buyer's personal data, except as provided by law;

6.2. The Seller has the right to:

- change the terms of the offer and prices without prior notice;

- cancel an order if the Buyer violates the terms of the agreement.

6.3. The Buyer undertakes to:

- review the terms of the agreement before placing an order;

- provide complete and accurate information for order fulfillment.

7. Return and Exchange of Products

7.1. In accordance with the Law of Ukraine "On Consumer Rights Protection," cosmetic products of proper quality are not subject to return or exchange unless they have a manufacturing defect.

7.2. Every order is checked before shipping for compliance and absence of defects.

7.3. The Buyer is required to inspect the Product upon receipt, paying attention to the packaging, completeness, and appearance.

7.4. If damage or non-conformity is found, the Buyer must notify the Seller immediately upon receiving the Product.

7.5. If a manufacturing defect is confirmed, the Seller will exchange the Product or issue a refund within 5 (five) business days from the date the returned Product is received.

8. Liability of the Parties

8.1. The Parties are liable for fulfilling their obligations in accordance with the current legislation of Ukraine.

8.2. The Parties are released from liability in the event of force majeure circumstances (war, emergencies, actions of government authorities, natural disasters, etc.).

8.3. A Party unable to fulfill its obligations due to force majeure must notify the other Party within 3 calendar days.

9. Confidentiality and Personal Data Protection

9.1. The Seller undertakes not to disclose the Buyer's personal data to third parties, except as provided by law or necessary for order fulfillment.

9.2. The Buyer is responsible for the accuracy of the personal data provided.

10. Other Provisions

10.1. The agreement is concluded within the territory of Ukraine and is governed by the legislation of Ukraine.

10.2. All disputes are resolved through negotiations, and if no agreement is reached — through court proceedings in accordance with the legislation of Ukraine.

10.3. The invalidity of individual provisions of this agreement does not affect the validity of the other provisions.
